In placing an order with HOUSE OF NEWBURY, you are confirming that you have read, understood and agreed with all our Terms and Conditions, set out in accordance with The Consumer Protection (Distance Selling) (Amendment) Regulations (2005).
1.1 – “you” means the customer/the user of the sites.

1.4 – “goods” and “items” means products purchased.
Placing An Order & Payment.
2.1 – All orders must be placed through visiting our website and adding items into the shopping cart, following the online prompts.
2.2 – Payment can be made online by Visa Credit and Debit, MasterCard, Maestro, Visa Electron via PayPal's secure servers.
2.3 – Orders will only be dispatched once the full payment has been received and cleared and within the estimated delivery time-frame specified when you place your order..
2.4 – If paying by cheque, orders will only be dispatched once the cheque has cleared.
2.6 – As stipulated by English law, to lawfully enter into and form a contract with House of Newbury and to purchase products from House of Newbury you must –
2.6.1 - Provide your real name, e-mail address, payment details and other requested information .
2.6.2 - Be over 18 years of age.
2.6.3 - Stipulate a delivery address.
2.6.4 - Own a valid credit or debit card issued by a bank that is acceptable to us.
26.5 - We will not post any orders to a PO BOX address and your order will be immediately cancelled if a PO Box address appears. The Customer is responsible for any extra fees imposed during or after shipping overseas.
3.1 – House of Newbury advises its customers to keep their username and password confidential and not to disclose their details to any unauthorised individuals.
3.2 –House of Newbury will not refund those customers who have not kept their details secure and who have had their accounts used to place orders for others or for bogus orders.
3.3 – If we consider that there is likely to be or has been a breach of security, we reserve the right to suspend any username and password access to the site and therefore to our services offered.
3.4 – We reserve the right to require you to change any username or password used to access www.houseofnewbury.co.uk.

Prices & Product Descriptions.
4.1 – We reserve the right at any time to make alterations to a product price – the price shown for a product on our website will be the most current price you are to pay.
4.2 – We have taken the utmost care to ensure that our product descriptions are accurate. If you feel the product does not match its description and would like to return the item (at your own cost), please follow our returns procedure.
4.3 – All prices currently do not require the inclusion of VAT as ©House of Newbury is under the threshold for VAT.
4.4 – Dimensions (height, width, weight or diameter) are given in metric measurements and are approximate.
5.1 – All contents of this website and our company's social media links are our intellectual property, trademark and copyright. This includes all text, blog content, images, logos, graphics, patterns, designs and our company name are owned entirely by House of Newbury and cannot be reproduced without obtaining prior written permission, otherwise legal action will be brought against you.

Risk & Property.
8.1 – Until full payment has been received and funds have been cleared, the ownership of all goods shall not pass to you.
8.2 – Once an order has been posted to you, we will not be held responsible for lost or damaged or delayed items in the post.
8.3 – All responsibility for risk of damage to goods or loss of goods shall or delay of goods pass to you once the goods have been dispatched by us.
8.4 - House of Newbury always retains receipts for proof of postage. The tracking details will help you with your claim against the Royal Mail.
Offer of Purchase.
9.1 – We reserve the right to reject any offer of purchase made by you at any given time. Reasons may include payment failures, error in prices or descriptions and unavailability of a product.
9.2 – In the event that an offer of purchase is rejected, an explanation will be provided by us.
10.1 – You are entitled to exercise your right to cancel your order within 7 days of placing your order with us and receive a full refund. On some occasions work may have already started on your Keepsake within the first 7 days especially if you have requested an urgent order, so clothing may have already been cut and therefore no compensation will be given for this, even if you cancel your order within 7 days. We therefore try not to start work on keepsakes until the initial 7 days have passed in order to preserve the clothes sent. After 7 days of placing your order, no refunds will be given at all unless the item was damaged by us prior to dispatch and once we have received from you the said damaged item back for full inspection within 7 days; starting the day after your products have been received. No refunds in any way will be offered if you have had the item longer then 7 days, as this is deemed you being satisfied with your order. Any eligible refunds will be made 30 days of receiving the damaged item back.
10.2 – To exercise your right to cancel the order, please contact us by e-mailing firstname.lastname@example.org. In the event that your order has already been dispatched, please follow our Returns Policy guidelines. All e-mail enquires will receive a response within 5 working day.
10.3 - All deposits are non-refundable.

13.1 – In entering in to a contract with House of Newbury through purchasing from our website or facebook page, you acknowledge we hold no responsibility for any liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against House of Newbury due to any breach by you of these Terms and Conditions or any other liabilities arising out of your use of House of Newbury services.
14.1 - At House of Newbury, we provide a service which is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether expressed or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. You further acknowledge that some of the content is supplied by third-parties and for that reason we can offer no warranty in relation to such content under any circumstance.
Fabric Keepsakes Disclaimer & Silver Prints Disclaimer
15.1 - Our Fabric Keepsake Bears, Bunnies, Dolls and any other Animal/Doll type keepsakes not CE Marked, and cannot be CE Marked due to them being made from Recycled used Fabrics/Clothes/Materials the customer has provided. Any purchase you make from House of Newbury includes our Terms and Conditions and it is your responsibility to ensure that you have read and understood them before placing and order with us. Our Terms and conditions are available for all to freely read on our website. Fabric Keepsake Bears, Bunnies, Dolls and any other Animal/Doll type keepsakes are an Adult Collectable Only and not a Toy. You must not allow this product to be used by any Children under the Age of 14, no matter how appealing the product my seem to children under the age of 14. The price of this product has been increased to reflect that this product is sold as an Adult Collectable. "You" as the customer, agree to keep the product away, out of reach & out of sight, away from any children under the age of 14 and to keep any tags/labels for future reference & dispose of any unwanted wrappers/packaging safely.
15.2 - All Keepsakes are handmade and every one is unique - no two keepsakes are ever the same and you therefore acknowledge that your keepsake represents the clothes that you provided and that you cannot expect it to look exactly like the one in any of our previous advertisements, photographs, shop display's etc. No refunds will be given at all if you do not like the look of your keepsake. Remnants of any leftover fabric will not be returned unless requested to do so by the customer and therefore the customer will be liable for the postage cost to return the said remnant fabric back to them.
15.3 - House of Newbury kindly requests that all clothing be freshly laundered before posting and customers follow the washing your keepsake guidelines in the Frequently Asked Questions Page before and after purchasing. No refunds will be given at all because you did not follow the guidelines and because the Fabric Photographs and the Fabric Prints have faded because you washed your keepsake at a high temperature and then tumble dry it!
15.4 - We do not accept any liability whatsoever if you lose or damage your Silver Print Keepsake once we have posted the item to you.
15.5 - Our Sterling Silver accessories are provided free of charge, such as Sterling Silver Jump Rings, Sterling Silver Snake Chain Necklaces and Bracelets and all other additional accessories that can be purchased from our website our sourced from a reputable supplier in Hatton Garden, London. We do not provide cheap fake imports from China and we take great pride in the quality of products we provide. All of our handcrafted Pendants and Charms are made from 99.9% Fine Silver. Any claims stating otherwise will be taken seriously and refuted.
15.6 - Prints will only be kept on file for 6 months from the date of your purchase. Any future orders after this date means that you will need to purchase further prints kits, unless you can provide copies of the originals.
15.7 - "You" as the customer, agree that if you do not accept these Terms & Conditions you will not proceed with the completion of the sale & that you fully accept all responsibility & full liability of the Product, as soon as you have purchased it from us.
Limitation of Liability & Disclaimer Continued.
16.1 – We make no warranty that will remain free from interruptions or errors whilst being used by its customers, that defects will be corrected or that it, or the server, will remain free from viruses or anything else detrimental to its customers and their computer systems.
16.2 – Any ordering process deemed to be erroneous due to technical difficulties or other reasons beyond our control entitles us to void any order.
16.3 – In the event that any item/s purchased from us becomes defective within 7 days of delivery, please e-mail us as soon as the defect becomes noticeable, returning the items to us for inspection and providing full details of the defect. We will then decide whether the defect is the responsibility of House of Newbury. If decided it is our responsibility, we will agree to either repair the item/s or replace with similar item/s. Please note – we will make this decision without consulting the customer and by accepting these terms and conditions you agree to this. All return postage costs will be reimbursed by us if deemed the defect is result of a manufacturing fault. We do not accept any responsibility for damage sustained to an item where those written recommendations provided in relation to an item have not been followed by you or a third party.
16.4 - House of Newbury, to the extent permitted by law, will not be liable for any indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with House of Newbury or the use of www.houseofnewbury.co.uk
17.1 – In the event that we are prevented from performing any of our obligations to you due to circumstances beyond our reasonable control, we will not hold any liability. These circumstances may include, but are not limited to, extreme weather conditions, acts of God, war, terrorism, difficulty in obtaining goods from our suppliers and strike. We reserve the right to terminate the contract under any of these circumstances.
18.1 – These Terms and Conditions are governed by the laws of England and you hereby consent to the jurisdiction of the English courts.
